Abstract

技术领域
本发明涉及确认授权的欧洲专利申请的方法，尤其是涉及用于向每个国家的欧洲律师提供确认指示的计算机实现的系统。
背景技术
目前确认欧洲专利的方法对本领域技术人员来说是公知的，且涉及很多在客户及其欧洲代理人(agent)之间进行的纸件手工处理。当前方法的一个缺点是，当处理链中的每个律师(attorney)处理文件时，他们向客户收取附加费，因而增加了确认费用。已知方法的另一缺点是，确认过程的实际费用不对客户提前公开，当发票最终到来时，客户通常惊异于高昂的费用。已知方法的进一步的缺点是，因为没有预先计算实际的费用，专利代理人不能给其报酬开账单，直到确认过程结束。然后他们必须等待客户支付账单，这通常花费几个月。
发明内容
根据本发明的第一方面，公开了一种用于分发确认指示消息(validationinstruction message)的计算机系统，所述计算机系统适合于与接口、说明书数据库以及多个欧洲代理人计算机通信。
所述接口包括：
适合于接收欧洲专利标识符的欧洲专利标识符接收器；以及
适合于接收国家选择的国家选择接收器，和适合于存储多个欧洲专利说明书的说明书数据库。
其中，当所述计算机系统接收到欧洲专利标识符和国家选择时，所述计算机系统适合于：
(a)从所述说明书数据库获得与所述欧洲专利标识符相应的欧洲专利说明书；以及
(b)向与所述国家选择相应的欧洲代理人计算机提供所述欧洲专利说明书和所述确认指示消息。
优选地，所述计算机系统适合于通过下列方法中的一个或多个向所述欧洲代理人计算机提供所述欧洲专利说明书：
(a)向所述欧洲代理人计算机发送附有所述欧洲专利说明书副本的电子邮件；以及
(b)将所述欧洲专利说明书存储在远程访问存储器中，并用电子邮件向所述欧洲代理人计算机发送能够访问所存储的欧洲专利说明书的链接。
优选地，所述计算机系统以加密形式将所述欧洲专利说明书存储在所述远程访问存储器中。
优选地，所述确认指示消息适合于指示与所述欧洲代理人计算机相关联的欧洲代理人向与所述国家选择相应的国家专利局确认与所述欧洲专利标识符相应的授权的欧洲专利。
优选地，所述计算机系统进一步适合于计算确认与所述欧洲专利标识符相应的欧洲专利的费用。
优选地，所述计算机系统适合于经由所述接口显示所述费用。
优选地，所述接口包括字计数接收器，其适合于接收与所述欧洲专利说明书中的字数相应的字计数。

(a)欧洲专利标识符；
(b)一个或更多国家选择；以及
(c)指示者信息，
且所述接口包括下列一项或更多项：
(a)欧洲专利标识符接收器，其适合于接收所述欧洲专利标识符；
(b)国家选择器，其适合于接收所述一个或更多国家选择；以及
(c)指示者信息接收器，其适合于接收所述指示者信息。
优选地，当所述接口接收到包括欧洲专利标识符和国家选择的欧洲确认指示时，它适合于指示计算机系统：
(a)从说明书数据库获得与所述欧洲专利标识符相应的欧洲专利说明书；以及
(b)向与所述国家选择相应的欧洲代理人计算机提供所述欧洲专利说明书和确认指示消息。
本发明还提供了一种包括程序指令的计算机程序，程序指令被装入计算机时，构成上述计算机系统。
本发明另外提供了一种包括程序指令的计算机程序，程序指令被装入计算机时，构成上述接口。
本发明所提供的上述计算机程序可体现在记录介质上，可存储在计算机存储器中，可体现在只读存储器中，可在电载波信号上携带。

具体实施方式
图1示出计算机系统1，其设计成向多个欧洲律师8发送确认指示消息10，请求他们确认授权的欧洲专利。计算机系统设计成与接口2、说明书数据库3和多个欧洲代理人8通信。
接口2可采用互联网可访问的网站的形式，并具有欧洲专利标识符接收器4，例如文本框。欧洲专利标识符接收器设计成接收欧洲专利标识符5，例如欧洲专利号或公布号。该标识符用于唯一地识别需要确认的授权的欧洲专利。
接口2还具有国家选择接收器6，其可采用包括文本框、单选按钮、下拉框、复选框等很多形式来指定若干项。国家选择接收器6设计成接收国家选择7，该国家选择7指出用户希望确认其欧洲专利的国家。
一种接口形式可能看起来类似于图2a到图2d所示的接口。
回到图1，说明书数据库3设计成存储多个欧洲专利说明书9。说明书数据库可采用getthepatent.com数据库、Espacenet数据库或存储所公布的授权欧洲专利说明书的任何其它数据库的形式。
建立系统，以便当计算机系统1经由接口2接收欧洲专利标识符5和国家选择7时，计算机系统：
(a)从说明书数据库3获得与欧洲专利标识符相应的欧洲专利说明书9；以及
(b)向与国家选择相应的特定欧洲代理人11提供欧洲专利说明书9和确认指示消息10。
通过向欧洲代理人11发送说明书9和确认指示消息10，系统指示欧洲代理人在他们国家确认该专利。如果需要，确认指示消息也指示欧洲代理人11将说明书翻译成他们当地专利局接受的语言。可选地，根据说明书是否使用他们各自的当地专利局接受的语言，由欧洲代理人承担翻译的决定。
计算机系统通过给欧洲代理人11发送附有欧洲专利说明书副本的电子邮件14，可向欧洲代理人提供欧洲专利说明书9。可选地，计算机系统可将欧洲专利说明书存储在远程访问存储器15中，并可仅仅用电子邮件向欧洲代理人发送到所存储的欧洲专利说明书的链接。在一种方式中，计算机系统以加密形式将欧洲专利说明书15存储在远程访问存储器中。远程访问存储器可采用在线文件交换入口的形式，例如在www.projectlounge.com找到的。也可设想向代理人11电子发送欧洲专利说明书的可选形式。
当然，当我们说向欧洲代理人发送电子邮件时，真正发生的是，向被欧洲代理人控制的计算机系统发送电子邮件，欧洲代理人可阅读该电子邮件并且根据该电子邮件行动。
优选实施例的计算机系统还能够计算所有的确认费，包括律师费、政府费和翻译费。客户用这种方法预先知道所有的费用，且可给他们提前开账单。律师也可较快地收到他们的付款。
欧洲确认中的一个重要因素是翻译费。为了准确计算该费用，需要知道说明书中的字数。由于这个原因，接口2包括字计数接收器12，如文本框，其适合于接收与欧洲专利说明书中字数相应的字计数16。计算机系统参考查找表13计算确认费。查找表存储特定国家信息，该信息逐条记录如下费用：
(a)代理人服务费；
(b)政府费；以及
(c)翻译费。
通过将字计数16乘以存储在查找表13中的每字翻译率，来计算翻译费。可选地，字计数可通过系统，或如果说明书采用文本格式则通过计算字数，或如果说明书采用图像格式提供则通过对其执行OCR(光学字符识别)，来自动初始化。很明显，因为仅仅计算字数，OCR处理的质量不是关键的，只要字间隔被准确辨别即可。
在每个国家的基础上增加代理人费用和政府费，以便得到总的确认费17。
一旦计算出费用，计算机系统在接口上显示费用。在优选实施例中，计算机系统链接到付款处理系统，以允许客户立即支付总的确认费用。在优选方式中，系统向每个欧洲代理人8分配酬金的比例，并以自动的方式支付他们那些比例。
上面的系统设计成减少与当前的欧洲专利确认系统相关联的纸件处理和律师费。它还考虑到费用的预先计算和开账单，使生活对客户和专利代理人都更容易。
虽然参考特定的例子描述了本发明，本领域技术人员应当理解，本发明可体现在很多其它形式中。

Claims (17)

1.一种用于计算欧洲专利确认费用的计算机系统，所述计算机系统具有中央处理单元和存储器，所述存储器具有存储在其上的：
(i)专利标识符接收器，其包括适合于接收和存储选择的专利标识符的一组程序化指令；
(ii)国家选择接收器，其包括适合于接收和存储电子国家选择的一组程序化指令；
(iii)查找表，其含有多个特定国家费用标准记录，所述特定国家费用标准记录包括至少一个特定国家翻译费标准；
(iv)费用标准引擎，其包括适合于参考所述特定国家费用标准记录来计算欧洲专利确认费用的一组程序化指令；
(v)说明书检索器，其包括适合于从专利说明书数据库检索电子专利说明书文件的一组程序化指令；和
(vi)字计数器，其包括适合于计算电子专利说明书文件中的字数的一组程序化指令；
其中，在使用中，当所述专利标识符接收器接收所述选择的专利标识符且所述国家选择接收器接收所述电子国家选择时，所述计算机系统自动执行下面的步骤：
(a)所述说明书检索器从所述专利说明书数据库检索相应于所述选择的专利标识符的选择的电子专利说明书文件；
(b)所述字计数器计算所述选择的电子专利说明书文件中的若干字以返回字计数；
(c)所述费用标准引擎：
(i)从所述查找表识别相应于所述电子国家选择的至少一个特定国家翻译费标准；和
(ii)将所述字计数插入到所述至少一个特定国家翻译费标准以产生特定国家翻译费用；和
(iii)返回所述特定国家翻译费用。
2.如权利要求1所述的计算机系统，其中所述电子专利说明书文件包括表示专利说明书的每一页的一系列图像，且其中所述字计数器还包括一组程序化指令，所述一组程序化指令适合于通过首先在所述一系列图像上执行光学字符识别OCR处理以产生每页说明书文档的文本版本，然后计算所述文本版本中的字数，来计算所述电子专利说明书文件中的字数。
3.如权利要求1或2所述的计算机系统，其中所述费用标准引擎还：
(i)从所述查找表识别相应于所述电子国家选择的至少一个特定国家律师费标准；
(ii)根据所述特定国家律师费标准产生特定国家律师费用；
(iii)返回所述特定国家律师费用。
4.如权利要求1至3中任一项所述的计算机系统，其中所述费用标准引擎还：
(i)从所述查找表识别相应于所述电子国家选择的至少一个特定国家政府费标准；
(ii)根据所述特定国家政府费标准产生特定国家政府费费用；
(iii)返回所述特定国家政府费费用。
5.如权利要求1至4中任一项所述的计算机系统，其中，当所述专利标识符接收器接收所述选择的专利标识符且所述国家选择接收器接收所述电子国家选择时，所述计算机系统向相应于所述电子国家选择的欧洲代理人计算机自动地提供所述选择的电子专利说明书文件和确认指令消息。
6.如权利要求5所述的计算机系统，其中所述计算机系统适合于通过下列方法中的一个或多个向所述欧洲代理人计算机提供所述选择的电子专利说明书文件：
(a)向所述欧洲代理人计算机发送附有所述选择的电子专利说明书文件副本的电子邮件；以及
(b)将所述选择的电子专利说明书文件存储在远程访问存储器中，并用电子邮件向所述欧洲代理人计算机发送能够访问所存储的所述选择的电子专利说明书文件的链接。
7.如权利要求6所述的计算机系统，其中所述计算机系统以加密形式将所述选择的电子专利说明书文件存储在所述远程访问存储器中。
8.如权利要求5所述的计算机系统，其中所述确认指示消息适合于指示与所述欧洲代理人计算机相关联的欧洲代理人向与所述国家选择相应的国家专利局确认与所述选择的专利标识符相应的授权的欧洲专利。
9.如权利要求1所述的计算机系统，还包括电子接口，且其中所述计算机系统还适合于经由所述接口显示所述特定国家翻译费用。
10.一种用于计算欧洲专利确认费用的电子接口，所述接口包括：
(i)专利标识符接收器，其包括适合于接收和存储选择的专利标识符的一组程序化指令；
(ii)国家选择接收器，其包括适合于接收和存储电子国家选择的一组程序化指令；
且所述接口适合于与下列部件通信：
(iii)查找表，其含有多个特定国家费用标准记录，所述特定国家费用标准记录包括至少一个特定国家翻译费标准；
(iv)费用标准引擎，其包括适合于参考所述特定国家费用标准记录来计算欧洲专利确认费用的一组程序化指令；
(v)说明书检索器，其包括适合于从专利说明书数据库检索电子专利说明书文件的一组程序化指令；和
(vi)字计数器，其包括适合于计算电子专利说明书文件中的字数的一组程序化指令；
其中，在使用中，当所述专利标识符接收器接收所述选择的专利标识符且所述国家选择接收器接收所述电子国家选择时，所述电子接口自动地指示：
(a)所述说明书检索器从所述专利说明书数据库检索相应于所述选择的专利标识符的选择的电子专利说明书文件；
(b)所述字计数器计算所述选择的电子专利说明书文件中的若干字以返回字计数；
(c)所述费用标准引擎：
(i)从所述查找表识别相应于所述电子国家选择的至少一个特定国家翻译费标准；和
(ii)将所述字计数插入到所述至少一个特定国家翻译费标准以产生特定国家翻译费用；和
