Abstract

Inserto para la unión de una funda al cojín de un asiento.#Comprende en principio un clip solidarizado a la masa de un cojín a través de unos medios adecuados, a la vez que cuenta la funda con una varilla para anclarse al citado clip. 2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention is an insert for the attachment of a cover to the cushion of a seat, having a clip integral with the mass of the cushion and a rod for anchoring to the clip, this having an elastic structure that delimits its interior space of loose accommodation of the respective rod, counting the clip with an open mouth in the resting state and flanked by terminal pins that are mechanically anchored together as a closure of the clip and of said mouth when the rod is inserted into the interior space and pressed through of such a rod on a bottom of that interior space of the clip, said terminal pins constituting elements of mutual engagement that contact each other to ensure a mechanical closure of the interior space. Document D01 is considered the state of the art closest to the invention, and discloses an insert for the attachment of a cover to a seat cushion, having a clip (200) integral with the mass of the cushion and a rod (100) for be anchored to the clip, this having an elastic structure that delimits its interior space of loose accommodation of the respective rod, counting the clip with an open mouth in rest state and flanked by end pins (220,215) as closing of the clip and said mouth when the rod is introduced into the interior space and is pressed through such a rod on a bottom of that interior space (225) of the clip, said terminal pins constituting hook elements that contact the determined shape of the rod to procure a mechanical closure of the interior space. The invention differs from document D01 in that in said document the terminal pins do not engage with each other, although this coupling must be partially because it has to leave enough space because the rod is in solidarity with the sheath and thus ensure closure mechanical but in this document is achieved through the coupling of the pins of the clip at the base of the rod. The technical problem that the invention solves is that the clip does not accidentally disassemble and guarantee easy disassembly through a sharp tool, which is solved by the invention disclosed in document D01 in the same way as disclosed in paragraphs 57 to 59. Knowing said document for a person skilled in the art it would be obvious to arrive at said engagement configuration between the ends of the pins as such coupling is made between the pin and the angular configuration of the insert. Therefore the invention in its first claim is new but lacks inventive activity according to articles 6.1 and

8.1 of patent law 11/1986. In the second claim it is claimed that said insert includes upper and lower end sections in which the respective pins are incorporated so that the upper end section is disposed on the lower one in the clip's closed position. No document has been found in the state of the art that discloses said provision. Therefore the invention in its second claim is new and involves inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. In the third claim, the invention discloses that the end sections of the clip are part of upper and lower side portions that end in end pins which form an angle of at least 90 ° with respect to said side portions being necessary to press on the portion side for disassembly of the rod with respect to the clip. In document D01 it is disclosed that the end sections of the clip are part of upper and lower side portions that end in end pins (215,220) which form an angle of at least 90 ° with respect to said side portions being necessary to press with an auxiliary tool (250) for disassembly of the rod with respect to the clip. The difference with the invention is that in one it is necessary to press on the lateral portion and in the other one on one of the portions of the rod achieving the same effect, the disassembly of the clip with respect to the rod. Therefore the invention in its third claim is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986.

WRITTEN OPINION

Claim 4 claims that the terminal pins form an acute angle with respect to the respective side portions, which is a further design variant according to the angle and therefore claim four is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. Claims 5 to 10 are of different embodiments of the invention in terms of design according to the different configurations given to the interior space, some of which is reflected in state of the art documents as is the case of the claim 8 which is reflected in documents D02 and D05. Therefore, for a person skilled in the art knowing both documents it would be obvious to use said configuration in one of his own and therefore claim eight is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986 and Claims 5, 6, 7, 9 and 10 are new and involve inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. Claim 11 claims that the insert comprises a surface base for fixing to the mass of the cushion, a neck that starts from that surface base and the clip attached to the neck. In the state of the art surface bases have been found to fix the mass of the cushion, however none have been found with a neck that starts from the base, therefore claim 11 is new and implies inventive activity according to the articles 6.1 and 8.1 of patent law 11/1986. Claim 12 claims that the space delimited by the clip provides a loose space of the rod for readjustment thereof. The documents of the prior art show said characteristic, therefore claim 12 is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. Claim 13 establishes that the contour of the clip is determined by an enveloping structure formed by straight sections, as reflected in the drawings of document D01 it is considered that the clip has a wrapping structure of straight sections and therefore the invention 13 is new but it lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. Claim 14 claims that the clips are joined by a cord of the same material as the clips themselves as disclosed in documents D03 and D04, therefore knowing said documents it is obvious for a person skilled in the art to incorporate said technical characteristics. to its invention and therefore claim 14 is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986. Claim 15 claims that the clip is part of a base part, a feature also disclosed in documents D03 and D04, therefore knowing said documents it is obvious for a person skilled in the art to incorporate said technical characteristics to his invention and therefore claim 15 It is new but lacks inventive activity according to articles 6.1 and 8.1 of patent law 11/1986.
