Istote wzoru stanowi nowa i indywidualna postac przedmiotu przejawiajaca sie w ukladzie linii oraz rysunku powierzchni i kolorystyce. Przedmiot wzoru przemyslowego przedstawiono na zalaczonym materiale ilustracyjnym, na którego fig. 1 pokazano w widoku czolowym tubke papierowa do lodów w stanie rozlozonym, z ukazanym nad nia wieczkiem zamykajacym tubke, natomiast na fig. 2 pokazano tubke papierowa do lodów w widoku czolowym. Jak przedstawiono na materiale ilustracyjnym tubka ma postac scietego stozka o lagodnym kacie rozwarcia, przy czym w jej dolnej czesci jest wykonane karbowanie poprzez naciecie szeregiem równoleglych wzgledem siebie poziomych przetloczen. W ostatnim z tych pól jest umieszczony napis ice wykonany czarna czcionka (Black 6C) o kroju prostym, malymi drukowanymi literami alfabetu lacinskiego. U dolu tubki zamieszczono wizerunek plastra limonki, u góry tubki czesciowo widoczne dwa plastry owocu limonki. Te elementy graficzne w kolorze zielonym (Pantone 376C). Z kolei wieczko zamykajace tubke od góry jest kolorystycznym odbiciem tubki, to jest na zielonym tle (Pantone 376C) jest powtórzony napis MOJITO oraz prostokatne pola, tym razem utrzymane w kolorystyce czarnej (Black 6C), natomiast napis ice na najwiekszym z pól jest wykonany czcionka w kolorze zielonym (Pantone 376C). The essence of the design is the new and unique form of the item, manifested in the arrangement of lines, surface drawing, and color. The industrial design is presented in the attached illustrations, where Fig. 1 shows a frontal view of the unfolded paper tube for ice cream, with the lid closing the tube visible above it, while Fig. 2 shows the frontal view of the paper tube for ice cream. As shown in the illustrations, the tube has the form of a truncated cone with a gentle opening angle, with a notch in the lower part made by cutting a series of parallel horizontal embossments. The tube is black (Black 6C), and in its central part is the inscription "MOJITO" in italics, in bold, capital Latin letters, in green (Pantone 376C). Parallel to the inscription, along its entire length, are a series of rectangular boxes in green (Pantone 376C), increasing in width. The last box contains the inscription "ice" in black (Black 6C), in a straight font, in lowercase Latin letters. At the bottom of the tube is an image of a lime slice, and at the top are two partially visible lime slices. These graphic elements are in green (Pantone 376C). In turn, the lid closing the tube from the top is a color reflection of the tube, i.e. on a green background (Pantone 376C) there is a repeated inscription MOJITO and rectangular fields, this time in black (Black 6C), while the inscription ice on the largest of the fields is made in a green font (Pantone 376C).
