PL 23354 2 Opis wzoru przemyslowego Przedmiotem wzoru przemyslowego jest etykieta dzemu przeznaczona do nanoszenia na fron- towe sciany jednostkowych opakowan, zwlaszcza na sciany frontowe opakowan szklanych. Istote wzoru przemyslowego stanowi nowa i posiadajaca indywidualny charakter postac wytwo- ru, nadana mu przez cechy linii, konturów i ksztaltów oraz przez motywy zdobnicze, wyrózniajaca szate graficzna i game kolorystyczna. Efekt estetyczny zapewnia subtelne skomponowanie rysunków przedstawiajacych swieze owo- ce i listki, oraz drewniana, stylizowana tablice, nadajac tym samym etykiecie oryginalny wyglad. Etykieta dzemu wedlug wzoru przemyslowego w trzech odmianach jest zobrazowana ilustracja na której: Fig. 1 – przedstawia pierwsza odmiane etykiety; Fig. 2 – przedstawia druga odmiane etykiety; Fig. 3 – przedstawia trzecia odmiane etykiety. Wykaz odmian etykiety dzemu wedlug wzoru przemyslowego: Odmiana 1 – przedstawiona na figurze 1, ilustrujaca etykiete dzemu agrestowego; Odmiana 2 – przedstawiona na figurze 2, ilustrujaca etykiete dzemu truskawkowego; Odmiana 3 – przedstawiona na figurze 3, ilustrujaca etykiete dzemu czeresniowego. Etykieta dzemu wedlug wzoru charakteryzuje sie tym, ze ma obszar o zarysie zblizonym do kwadratu, o zaokraglonych bokach. Tlo etykiety, we wszystkich odmianach wzoru jest transparentne. Przy górnej krawedzi etykiety, posrodku, we wszystkich odmianach wzoru, jest umieszczony ry- sunek stylizowanego ciemnozielonego listka, z krótka lodyzka i dwoma malymi dodatkowymi listkami. Stylizowany listek ma fantazyjny ksztalt nadany ciemnozielonym obrysem i bialym konturem w dolnej czesci listka. Nizej, pod rysunkiem listka, w centralnej czesci etykiety umiejscowiony jest rysunek stylizowa- nej, drewnianej tablicy, o zaokraglonych krawedziach, z ciemniejszym obramowaniem, na stojaku. Tablice wypelnia napis z nazwa dzemu oraz jego smakiem. Napis z nazwa dzemu wykonany jest po- grubiona czcionka, przypominajaca stylizowane pismo reczne w kolorze ciemnobrazowym. Napis informujacy o smaku wykonany jest czcionka bezszeryfowa, lekko pochylona w lewo, w kolorze kore- spondujacym ze smakiem owoców, które sa w skladzie dzemu. Ponizej rysunku tablicy w dolnej czesci etykiety jest naniesiony rysunek przedstawiajacy kore- spondujace z nazwa swieze owoce z listkami i szypulkami, dla których optyczny efekt trójwymiarowo- sci i swiezosci uzyskano dzieki miejscowym rozjasnieniom. Pierwsza odmiana wzoru przemyslowego uwidoczniona jest na Fig. 1. Wzór zawiera trzypozio- mowy napis „Z Dawnego Sadu, Dzem Agrestowy", przy czym slowa „Z Dawnego Sadu, Dzem" napi- sane sa pogrubiona, ciemnobrazowa czcionka, a slowo „Agrestowy" bezszeryfowa czcionka w kolorze zielonym. Rysunek ponizej tablicy przedstawia swieze owoce agrestu z listkami. Wzór przemyslowy uwidoczniony na Fig. 2 zawiera trzypoziomowy napis „Dzem Aksamitny, Truskawkowy", przy czym slowa „Dzem Aksamitny" napisane sa pogrubiona, ciemnobrazowa czcion- ka, a slowo „Truskawkowy" bezszeryfowa czcionka w kolorze czerwonym. Rysunek ponizej tablicy przedstawia swieze owoce truskawki z szypulkami. W tej odmianie wzoru, w lewej dolnej czesci ety- kiety, znajduje sie rysunek prostokatnej kartki papieru, przypietej do drewnianej tablicy za pomoca pinezki z dwupoziomowym napisem: „Dla dzieci! gladki i bez pestek!", wykonanym lekko pogrubiona czcionka, przypominajaca pismo reczne, przy czym napis „Dla dzieci!" wykonany jest czcionka w kolo- rze czerwonym, a „gladki i bez pestek!", czcionka w kolorze niebieskim. Pod rysunkiem kartki znajduje sie równiez dwupoziomowy napis „100 g owoców na 100 g dzemu!", wykonany biala czcionka. Etykie- ta w tej odmianie wyróznia sie takze tym, ze znajduja sie na niej rysunkowe postacie dzieci – chlop- czyka (po prawej stronie etykiety) i dziewczynki po lewej stronie etykiety. Dziewczynka ma blond wlosy i dwa kucyki, chlopczyk ubrany jest w zielona koszulke, niebieskie spodnie i czerwona czapke z daszkiem. Trzecia odmiana wzoru przemyslowego uwidoczniona jest na Fig. 3. Stylizowany listek ma fantazyjny ksztalt nadany ciemnozielonym obrysem i bialym konturem w dolnej czesci listka. • Nizej, pod rysunkiem listka, w centralnej czesci etykiety umiejscowiony jest rysunek styli- zowanej, drewnianej tablicy, o zaokraglonych krawedziach, z ciemniejszym obramowa- niem, na stojaku. Tablice wypelnia napis z nazwa dzemu oraz jego smakiem. Napis z nazwa dzemu wykonany jest pogrubiona czcionka, przypominajaca stylizowane pismo reczne w kolorze ciemnobrazowym. Napis informujacy o smaku wykonany jest czcionka bezszeryfowa, lekko pochylona w lewo, w kolorze korespondujacym ze smakiem owo- ców, które sa w skladzie dzemu. • Ponizej rysunku tablicy w dolnej czesci etykiety jest naniesiony rysunek przedstawiajacy korespondujace z nazwa swieze owoce z listkami i szypulkami, dla których optyczny efekt trójwymiarowosci i swiezosci uzyskano dzieki miejscowym rozjasnieniom. The essence of the industrial design is the product's new and unique appearance, imbued with lines, contours, and shapes, as well as decorative motifs, a distinctive graphic design, and a color palette. The aesthetic effect is achieved through a subtle composition of drawings depicting fresh fruit and leaves, and a stylized wooden board, giving the label a unique appearance. The jam label, in three variations, according to the industrial design is illustrated in the illustration below: Fig. 1 – shows the first variation of the label; Fig. 2 – shows the second variation of the label; Fig. 3 – shows the third variation of the label. List of jam label variations based on the industrial design: Variation 1 – shown in Figure 1, illustrating a gooseberry jam label; Variation 2 – shown in Figure 2, illustrating a strawberry jam label; Variation 3 – shown in Figure 3, illustrating a cherry jam label. The jam label based on the design is characterized by an area with a roughly square outline, with rounded sides. The label background, in all design variations, is transparent. At the top edge of the label, in the center, in all design variations, is a drawing of a stylized dark green leaf, with a short stem and two small additional leaves. The stylized leaf has a fanciful shape given by a dark green outline and a white contour at the bottom of the leaf. Lower down, beneath the leaf image, in the central part of the label is an image of a stylized wooden board with rounded edges and a darker border, mounted on a stand. The board is filled with an inscription with the name of the jam and its flavor. The inscription with the jam's name is in bold font, resembling stylized handwriting in dark brown. The inscription informing about the flavor is in a sans-serif font, slightly tilted to the left, in a color corresponding to the flavor of the fruits that comprise the jam. Below the board image, in the lower part of the label, is an image of fresh fruit with leaves and stalks corresponding to the name, for which the optical effect of three-dimensionality and freshness is achieved through localized highlights. The first variant of the industrial design is shown in Fig. 1. The design contains a three-level inscription "Z Dawnego Sadu, Dzem Gorestowy" (From the Old Orchard, Gooseberry Jam), with the words "Z Dawnego Sadu, Dzem" written in bold, dark brown font, and the word "Agrestowy" in sans-serif green font. The drawing below the table shows fresh gooseberries with leaves. The industrial design shown in Fig. 2 contains a three-level inscription "Dzem Velvet, Strawberry Jam", with the words "Dzem Velvetny" written in bold, dark brown font, and the word "Truskawkowy" in sans-serif red font. The drawing below the table shows fresh strawberry fruits with stalks. In this design variation, the lower left part of the label features a drawing of a rectangular piece of paper pinned to a wooden board with a pin, bearing a two-level inscription: "For children! Smooth and seedless!" in a slightly bold font resembling handwriting. "For children!" is in red, and "smooth and seedless!" is in blue. Below the drawing of the paper, there is also a two-level inscription: "100 g of fruit per 100 g of jam!" in white. This label also features cartoon figures of children – a boy (on the right side of the label) and a girl (on the left side of the label). The girl has blond hair and two pigtails, while the boy is wearing a green T-shirt, blue pants, and a red baseball cap. The third variant of the industrial design is shown in Fig. 3. The design contains a three-level inscription "Z Dawnego Sadu, Dzem Czeresniowy" (From the Old Orchard, Cherry Jam), with the words "Z Dawnego Sadu, Dzem" written in a bold, dark brown font, and the word "Czeresniowy" in a sans-serif burgundy font. The drawing below the table shows fresh cherries with leaves falling out of a wicker basket.
