Etykieta i jej motyw zdobniczy stosowa- ne sa dla wód mineralnych wydobywanych w miejscowosci Zubrzyk polozonej w gminie Piwniczna Zdrój, na terenie Województwa Malopolskiego. Motyw zdobniczy oraz etykieta wedlug wzoru przemyslowego uwidocznione sa w zestawie ilustracji zlozonym z czterech figur, z których kazda przedstawia kolejne odmiany niniejszego wzoru przemyslowego. Odmiany wzoru przemyslowego sa nastepujace Odmiana 1. Motyw zdobniczy etykiety zawiera w górnej czesci lukowe na- pisy wygiete posrodku w góre. Najwyzej umieszczony napis „Naturalna Woda Mi- neralna" stylizowany na pochyle pismo reczne. Pod nim jest duzy napis „Zdroje Piwniczna", wykonany czcionka drukowana bez pochylen, przy czym slowo „Zdro- je" umieszczone jest nad slowem „Piwniczna". Trzeci napis „delikatnie gazowana" wykonany jest pismem identycznym jak pierwszy, oraz podkreslony lukowa linialekko wygieta posrodku w góre. Wszystkie te napisy sa barwy ciemnozielonej ze srebrzystym polyskiem i srebrnym cieniowaniem. Ponizej napisów jest ilustracja przedstawiajaca krajobraz górski, w naturalnej kolorystyce. Na pierwszym planie przedstawiono rzeke z niebieska woda, za nia - na brzegu, lake z jasnozielona trawa, a w oddali wzgórza porosniete ciemnozielonym lasem. Nad lasem jest ble- kitne niebo z bialymi klebiastymi chmurami, na którego tle umieszczony jest wyzej omówiony napis „delikatnie gazowana". W dolnej czesci motywu zdobniczego etykiety jest prostokatna ciemnozielo- na tarcza, zakonczona u góry lukiem wspólgrajacym z liniami napisów, ze srebr- nym cieniowaniem poszerzajacym sie ku srodkowi. Na tarczy jest napis „Zubrzyk" bedacy nazwa miejscowosci, w której sa zlokalizowane zródla wody mineralnej oznaczanej etykieta i jej motywem zdobniczym. Napis ten ulozony jest poziomo oraz stylizowany na pochyle pismo reczne. Ponizej jest napis „ksiaze wód" wyko- nany kapitalikami, pochyla czcionka. Litery obu napisów na tarczy sa biale i maja srebrne obwódki. Po obu stronach tarczy rozmieszczone sa symetrycznie po dwa kola, a w kazdej parze tych kól jedno jest wieksze i usytuowane na zewnatrz bocznej kra- wedzi tarczy, a drugie, mniejsze, usytuowane jest nieco wyzej, majac swój srodek nad boczna krawedzia tarczy. W kole pierwszym z lewej strony (wiekszym), jest godlo Polskiego Towarzystwa Magnezologicznego, gdzie na bialym tle w srodku jest symbol chemiczny magnezu „Mg" w kolorze czerwonym, otoczony symbolami pierwiastków „Zn", „Se", „Co" i „Cu" oraz wizerunkami czterech róznobarwnych kulek, a takze biegnacym przy krawedzi okregu po wewnetrznej stronie napisem „Polskie Towarzystwo Magnezologiczne". Na zewnatrz okregu jest napis „Reko- mendowana przez" usytuowany przy lewej górnej cwiartce tego okregu. Obok kola z godlem jest mniejsze koto majace w ciemnozielonym otoku napis „bogata w ma- gnez", a wewnatrz na bialym tle - symbol chemiczny „Mg" tego pierwiastka w kolo- rze czerwonym. Po prawej stronie tarczy wieksze kolo ma na ciemnozielonym oto- ku napis „wysokozmineralizowana", a wewnatrz na bialym tle - liczbe mianowana „2100 mg/l" wskazujaca laczna ilosc skladników mineralnych. Znajdujace sie obok mniejsze kolo ma ciemnozielony waski otok, a wewnatrz niego, na bialym tle, jest liczba mianowana „1,5 I" wskazujaca pojemnosc póltoralitrowej butelki. Woda mi- neralna oznaczana etykieta z motywem zdobniczym wedlug niniejszej odmianywzoru przemyslowego sprzedawana jest równiez w butelkach póllitrowych, a wów- czas w tym kole wystepuje liczba mianowana „0,51". Odmiana 2. Motyw zdobniczy etykiety zawiera w górnej czesci lukowe na- pisy wygiete posrodku w góre. Najwyzej umieszczony napis „Naturalna Woda Mi- neralna" stylizowany na pochyle pismo reczne. Pod nim jest duzy napis „Zdroje Piwniczna", wykonany czcionka drukowana bez pochylen, przy czym slowo „Zdro- je" umieszczone jest nad slowem „Piwniczna". Na jednym z tych pól (usytu- owanym na fig. 3 miedzy motywami zdobniczymi), umieszczona jest u góry mapka Beskidu Sadeckiego z zaznaczeniem polozenia miejscowosci Zubrzyk, w otocze- niu miast uzdrowisk, takich jak: Piwniczna Zdrój, Muszyna, Krynica Zdrój. Motyw zdobniczy etykiety zawiera w górnej czesci lukowe napisy wygiete po- srodku w góre, z dominujacym napisem „Zdroje Piwniczna", w którym slowo „Zdroje" umieszczone jest nad slowem „Piwniczna", przy czym napisy sa barwy ciemnozielonej albo ciemnoniebieskiej, w obu przypadkach ze srebrzystym po- lyskiem i srebrnym cieniowaniem.2. Ponizej napisów (cecha 1) jest ilustracja przedstawiajaca krajobraz górski w naturalnej kolorystyce: rzeke, lake, w oddali wzgórza porosniete lasem, a ponad nim niebo z klebiastymi chmurami. 3. W dolnej czesci motywu zdobniczego etykiety jest prostokatna tarcza barwy ciemnozielonej albo ciemnoniebieskiej, zakonczona u góry lukiem wspólgraja- cym z liniami napisów, ze srebrnym cieniowaniem poszerzajacym sie ku srod- kowi. Etykieta na butelke wody mineralnej w postaci opasujacej butelke nalepki, za- wiera motyw zdobniczy, okreslony cechami nr 1-4 niniejszego wzoru przemy- slowego, a takze powtórzenie tego motywu zmodyfikowane nieco poprzez zmiane tresci napisu, przy czym oba motywy zdobnicze usytuowane sa w ten sposób, ze po naklejeniu etykiety na powierzchnie boczna butelki znajduja sie po przeciwnych stronach butelki. 6. Pomiedzy motywami zdobniczymi etykiety i na jej koncu sa pola z dodatkowymi informacjami, a w ich górnych czesciach, na jednym jest mapka Beskidu Sa- deckiego z zaznaczeniem polozenia miejscowosci Zubrzyk, a na drugim znak towarowy slowno-graficzny MASSPOL producenta wody mineralnej. 7. Wzdluz calej etykiety u góry przebiega poziomy srebrny pasek, a ponizej tlo jest biale, przechodzac w dolnej czesci plynnie w barwe srebrna o nasilajacej sie ku dolowi intensywnosci.Fig. 1 Fig. 2 Fig. 3 Fig. 4 PL PLLABEL DECORATIVE MOTIF AND BOTTLE LABEL The subject of the industrial design is the decorative motif of a label for a bottle of natural mineral water, as well as a label intended to be stuck around the bottle, containing this decorative motif. The label and its decorative motif are used for mineral waters mined in the town of Zubrzyk, located in the Piwniczna-Zdrój commune, in the Lesser Poland Voivodeship. The decorative motif and label based on the industrial design are shown in a set of illustrations composed of four figures, each representing subsequent variations of this industrial design. The individual figures in the drawing show: Fig. 1 - decorative motif of a label intended for low-carbonated water; Fig. 2 - decorative motif of a label intended for high-carbonated water; Fig. 3 - label (unfolded) with the decorative motif from Fig. 1; Fig. 4 - label (unfolded) with the decorative motif from Fig. 2. Variations of the industrial design are as follows: Variation 1. The label's decorative motif includes arcuate inscriptions in the upper part, bent upwards in the center. The uppermost inscription is "Natural Mineral Water," stylized to resemble cursive handwriting. Below it is a large inscription, "Zdroje Piwniczna," written in a non-curved font, with the word "Zdroje" placed above the word "Piwniczna." The third inscription, "delicately carbonated," is written in a font identical to the first, and is underlined by an arcuate line slightly bent upwards in the center. All these inscriptions are dark green with a silver sheen and silver shading. Below the inscriptions is an illustration of a mountain landscape in natural colors. In the foreground is a river with blue water, behind it – a lake with light green grass on the shore, and in the distance, hills covered with a dark green forest. Above the forest is a blue sky with white, puffy clouds, against which the above-mentioned inscription "gently sparkling" is placed. At the bottom of the label's decorative motif is a rectangular, dark green shield, topped with an arc at the top that harmonizes with the lines of the inscriptions, with silver shading widening towards the center. On the shield is the inscription "Zubrzyk," the name of the town where the mineral water springs identified by the label and its decorative motif are located. This inscription is arranged horizontally and stylized as cursive handwriting. Below is the inscription "prince of waters" in small capitals, italicized. The letters of both inscriptions on the shield are white and have silver borders. On both sides of the shield are two symmetrically arranged circles, and in each pair of circles, one is larger and located on the outside of the side edge of the shield, while the other, smaller, is located slightly higher, with its center above the side edge of the shield. In the first circle on the left (the larger one), there is the coat of arms of the Polish Magnesium Society, where on a white background in the center is the chemical symbol for magnesium "Mg" in red, surrounded by the symbols of the elements "Zn", "Se", "Co", and "Cu" and images of four multicolored balls, as well as the inscription "Polish Magnesium Society" running along the edge of the circle on the inner side. Outside the circle is the inscription "Recommended by" located in the upper left quarter of the circle. Next to the circle with the emblem is a smaller circle with the inscription "rich in magnesium" in a dark green circle, and inside on a white background is the chemical symbol "Mg" for this element in red. To the right of the shield, a larger circle has the inscription "highly mineralized" in a dark green circle, and inside on a white background is the designated number "2100 mg/l," indicating the total amount of minerals. The smaller circle next to it has a narrow dark green circle, and inside it, on a white background, is the designated number "1.5 l," indicating the capacity of a one and a half liter bottle. Mineral water marked with a label with a decorative motif according to this variant of the industrial design is also sold in half-liter bottles, and in this case the designated number "0.51" appears in this circle. Variant 2. The decorative motif of the label includes, in the upper part, arched inscriptions bent upwards in the center. The smaller circle next to it has a narrow dark blue rim, and inside it, on a white background, is the designated number "1.5 l," indicating the capacity of a one and a half liter bottle. Mineral water marked with a label with a decorative motif according to this variant of the industrial design is also sold in half-liter bottles, and then the number "0.51" appears in this circle. Variant 3. The label for a mineral water bottle in the form of a sticker surrounding the bottle contains a decorative motif, which is the first variant of the design, as well as a repetition of this motif slightly modified by replacing the inscription "slightly carbonated" with the inscription "low-saturated CO2". Both decorative motifs are positioned in such a way that when the label is stuck to the side surface of the bottle, these motifs are on opposite sides of the bottle. Between the decorative motifs of the label and at its end there are fields with additional information, and after the label is stuck to the bottle, the end field is also located between the decorative motifs. One of these fields (located between the decorative motifs in Fig. 3) features a map of the Beskid Sadecki Mountains at the top, marking the location of the town of Zubrzyk, surrounded by spa towns such as Piwniczna-Zdrój, Muszyna, and Krynica-Zdrój. Below the map is text describing the properties of the mineral water and a table listing the contents of individual ingredients. The second field with additional information (in Fig. 3, to the right of the decorative motif according to variety 1) features the MASSPOL trademark, a combination of words and graphics, belonging to the manufacturer of the mineral water for which the label is intended. Below this is text with the manufacturer's contact details, information about the water being extracted from the "Z-2" borehole, and other product information—all of which is set against a large, pale green "Z-2" inscription, positioned vertically. Below the text is a barcode. A horizontal silver stripe runs along the entire label at the top. Below that, the label's background is white, gradually fading into a silver color at the bottom, with intensity increasing toward the bottom. Variation 4. The mineral water bottle label, in the form of a sticker that encircles the bottle, contains a decorative motif, which is the second variation of the design, as well as a repetition of this motif, slightly modified by replacing the word "carbonated" with the word "highly saturated CO2." Both decorative motifs are positioned so that when the label is applied to the side of the bottle, they appear on opposite sides of the bottle. Between the label's decorative motifs and at the end are fields with additional information, and after the label is affixed to the bottle, the final field is also located between the decorative motifs. One of these fields (located between the decorative motifs in Fig. 4) features a map of the Beskid Sądecki Mountains at the top, indicating the location of the village of Zubrzyk, surrounded by spa towns such as Piwniczna-Zdrój, Muszyna, and Krynica-Zdrój. Below the map is text describing the mineral water's properties and a table listing the individual ingredients. The second field with additional information (in Fig. 4, to the right of the decorative motif according to variant 2) features the MASSPOL trademark at the top, a combination of words and graphics, belonging to the manufacturer of the mineral water for which the label is intended. Below is text with the manufacturer's contact details, information about water extraction from the "Z-2" well, and other product information – all of this text is placed against a large, vertically bluish-gray "Z-2" inscription. Below the text is a barcode. A horizontal silver stripe runs along the entire label at the top. Below, the label's background is white, smoothly transitioning to a silver color at the bottom, the intensity of which increases towards the bottom. Essential features of the industrial design The decorative motif of the label and the bottle label are characterized by the following essential features: 1. The decorative motif of the label contains, in the upper part, arched inscriptions bent upwards in the middle, with the dominant inscription "Zdroje Piwniczna", in which the word "Zdroje" is placed above the word "Piwniczna", the inscriptions being dark green or dark blue, in both cases with a silver sheen and silver shading. 2. Below the inscriptions (feature 1) there is an illustration of a mountain landscape in natural colors: a river, a lake, in the distance hills covered with forest, and above it a sky with puffy clouds. 3. In the lower part of the label's decorative motif is a rectangular shield in dark green or dark blue, topped with an arc at the top that matches the lines of the inscriptions, with silver shading widening towards the center. On the shield is the inscription "Zubrzyk" and below it the inscription "prince of waters". 4. On both sides of the shield are two symmetrically placed circles, and in each pair, the larger one is located on the outside of the side edge of the shield, and the smaller one has its center above the side edge of the shield. Inside these circles are, from the left: the emblem of the Polish Magnesium Society, the inscription "rich in magnesium" with the chemical symbol "Mg" for this element, information about the bottle's capacity, and the inscription "highly mineralized" with the total content of "2100 mg/l" of minerals. 5. The label for a mineral water bottle, in the form of a sticker encircling the bottle, contains a decorative motif defined by features no. 1-4 of this industrial design, as well as a repetition of this motif slightly modified by changing the text of the inscription. Both decorative motifs are positioned so that when the label is affixed to the side surface of the bottle, they are on opposite sides of the bottle. 6. Between the decorative motifs on the label and at the end thereof are fields with additional information, and in their upper parts, one contains a map of the Beskid Sadecki Mountains indicating the location of the town of Zubrzyk, and the other contains the MASSPOL verbal and figurative trademark of the mineral water manufacturer. 7. A horizontal silver stripe runs along the entire label at the top, and below it the background is white, smoothly changing into a silver color in the lower part, the intensity of which increases towards the bottom.
