Przedmiotem wzoru przemyslowego jest tkanina dekoracyjna przeznaczona na obicia mebli tapicerowanych lub jako material na narzuty na tapczany, lózka czy fotele, a takze na zaslony i poszycia poduszek. Znane sa tkaniny dekoracyjne szenilowe gladkie oraz posiadajace wzory o motywach roslinnych, zwierzecych lub geometrycznych, albo o zdobieniach mieszanych. Istote wzoru przemyslowego stanowi nowa i posiadajaca oryginalny charakter postac tkaniny, nadana jej w szczególnosci przez lysunek i rodzaj powierzchni. Miejscami splot tkaniny jest rzadszy i tworzy prostokatne pola, a miejscami jest scislejszy tworzac pola nieregularne. Na powierzchni tkaniny wystepuje takze rysunek w postaci rzadko rozrzuconych pojedynczych kwiatów przypominajacych róze na galazkach z lisciem, figur zblizonych do kwadratów oraz nieregularnych wiazek zygzaków. Wiazki zygzaków usytuowane sa tak, ze jedne sa poprzeczne, a inne podluzne, a ich linie sa miejscami jasniejsze i ciemniejsze. Jedne, najwieksze wiazki zygzaków znajduja sie na nieregularnym polu o scislym splocie tkaniny, a w ich sasiedztwie widnieja trzy figury zblizone do kwadratów usytuowane wzdluz linii prostej biegnacej wzdluz ich przekatnych. Wszystkie wzory na tkaninie maja powierzchnie gladka i blyszczaca.Cechy istotne wzoru przemyslowego sa takie, ze tlo tkaniny jest cieniowane, a splot tkaniny miejscami jest rzadszy i tworzy prostokatne pola, a miejscami jest scislejszy tworzac pola nieregularne. Uzyskana informacja o rezultacie przekazu byla OK Po telefonicznych wyjasnieniach powodu nadania przedmiotowemu zgloszeniu daty 18.08.2004r. zamiast 16.08.2004r. okazalo sie, ze fax z dokumentacja zgloszeniowa omawianego wzoru przemyslowego „dotarl" do Urzedu w dniu 16.08.004r., lecz z powodu urlopu Pana dyrektora Adamusa nie zostal wczesniej odczytany. PL PL PLThe subject of the industrial design is a decorative fabric intended for upholstery of upholstered furniture or as a material for throws on couches, beds, or armchairs, as well as for curtains and cushion covers. Plain decorative chenille fabrics are known, as well as those with patterns featuring floral, animal, or geometric motifs, or with mixed decorations. The essence of the industrial design is a new and original form of fabric, given to it in particular by the pattern and type of surface. The subject of the industrial design is shown in the photograph (Fig. 1), showing a drawing on the fabric, and in the fabric sample (Fig. 2), showing the fabric's texture. The decorative fabric according to the industrial design is a chenille fabric with a porous and soft surface resembling velvet, and a shaded background. In places, the fabric weave is looser, creating rectangular fields, while in other places it is tighter, creating irregular fields. The fabric's surface also features a pattern of sparsely scattered single flowers resembling roses on leafy branches, square-like figures, and irregular bundles of zigzags. The zigzag bundles are arranged so that some are transverse and others longitudinal, with their lines varying in lighter and darker shades. One, the largest, bundle of zigzags is located on an irregular field with a tightly woven fabric, and adjacent to them are three square-like figures arranged along a straight line running along their diagonals. These squares have a full, light interior and are outlined with Unions nrmmajnaynij and lighter shades. The flowers on the branches have darker petals with lighter petals surrounding them, and shaded leaves, some with a leaf attached to the branch, while others have a leaf that extends away from it. The former have zigzags at the base, while the latter have convoluted lines in the center. All patterns on the fabric have a smooth and shiny surface. The essential features of the industrial design are that the fabric background is shaded, and the weave is sometimes more loose, creating rectangular fields, while in others it is tighter, creating irregular fields. The fabric's surface also features sparsely scattered individual flowers resembling roses on branches with leaves, figures resembling squares, and irregular clusters of zigzags. The zigzag lines are arranged so that some are transverse and others longitudinal, with their lines varying in lighter and darker areas. One, the largest, zigzag line is located on an irregular, tightly woven field, and adjacent to it are three square-like figures arranged along a straight line running along their diagonals. These squares have a solid, light interior and are outlined with darker and lighter lines. The flowers on the branches have darker petals with lighter outlines and shaded leaves, some with a leaf adjacent to the branch, others with a leaf that is angled away from it. The application documentation for the above-mentioned industrial design was submitted to the Patent Office of the Republic of Poland by fax on 16/08/2004 at 9:00 a.m. 16:23 from the number (0 61) 848-49-07 to the number (0 22) 875-73-04 (this is the number we had previously received as the next possible number for submitting applications, apart from the number (0 22) 875-06-80, which on 16/08/04 was busy for quite a long time at the time of sending the fax). The information obtained about the result of the transfer was OK. After explaining over the phone the reason for assigning the date of 18/08/2004 to the application in question instead of 16/08/2004, it turned out that the fax with the application documentation for the industrial design in question "received" the Office on 16/08/004, but due to the holiday of director Mr. Adamus, it was not read earlier. Through the Patent Office Information Service, it was agreed in the Department of Registration that the application for registration of the industrial design entitled "Decorative fabric", designated with the number Wp-6419, will be given the date of August 16, 2004.
