Istota wzoru przemyslowego jest nowa postac opakowania kosmetyków przejawiajaca sie w jego indywidualnym charakterze nadanym mu przez ksztalt, kompozycje graficzna zwlaszcza tla, kolorystyke, uklad elementów slownych i liternictwo przez co uzyskano oryginalny wyglad zewnetrzny opakowania, podnoszac atrakcyjnosc dla nabywców, znajdujacych sie w opakowaniu wyrobów kosmetycznych. Opakowanie kosmetyków i jego odmiany przedstawione jest na zalaczonej ilustracji, na której: Fig. 1 – pokazuje opakowanie przeznaczone dla mydla siarkowego, w postaci rozlozonej w widoku z góry; Fig. 2 – uwidacznia widok z góry rozlozonego opakowania przeznaczonego na nawilzajacy krem siarkowy; Fig. 3 – przedstawia opakowanie przeznaczone na matujacy krem siarkowy, w widoku z góry w postaci rozlozonej. Na górnej sciance (pokrywy, wieczka) wszystkich odmian opakowania umieszczony jest napis skladajacy sie z wyrazów: BARWA Siarkowa, stanowiacy nazwe serii produktu. Wyraz BARWA pisany jest duzymi drukowanymi literami w kolorze turkusowym. Umieszczone ukosnie pod i zachodzace górnymi czesciami liter na wyraz w BARWA, slowo Siarkowa wykonane jest odrecznym stylizowanym pismem w kolorze czarnym z popielatym obrysem. Nad koncowa litera („a") slowa Siarkowa umieszczony jest w kólku znak „R" informujacy o zastrzezonym znaku towarowym nr 281173 producenta. Na czolowej scianie, kazdej odmiany opakowania umieszczona jest nazwa serii produktu: BARWA Siarkowa – identyczna jak na górnej sciance (pokrywy). Pod dominujaca nazwa serii znajduje sie pisane w dwuwierszu okreslenie podajace rodzaj i nazwe produktu umieszczonego w opakowaniu. Pod okresleniem rodzaju produktu umieszczony jest jednowierszowy napis: PIELEGNACJA ANTYTRADZIKOWA, wykonany czarnymi, drukowanymi wersalikami. Ponizej, w pomaranczowej ramce na zóltawym tle jest umieszczony zapis przyblizajacy produkt zawarty w opakowaniu. Pod ramka podana jest w jezyku angielskim informacja o przeznaczeniu produktu. Na samym dole czolowej sciany opakowania znajduje sie logo producenta w kolorze bialym. Lewe boczne sciany, kazdej odmiany opakowania zawieraja napisy informacyjne w kilku jezykach wykonane drobnym czarnym drukiem. Natomiast na prawych bocznych scianach opakowania obok tekstu informacyjnego, znajduja sie pelne dane producenta, gramatura produktu i jego kod kreskowy wykonane w kolorze czarnym, przy czym kod kreskowy jest na bialym tle a u góry posiada haslo reklamowe w kolorze jasnopomaranczowym. Na tylnych scianach kazdej odmiany opakowania znajduja sie niezbedne i wymagane informacje o produkcie, umieszczone jedna pod druga w pomaranczowych ramkach o zóltawym tle. W górnych rogach ramek sa niebieskie piktogramy w pomaranczowych kólkach korespondujace z trescia zawartych w ramkach informacji. Dolna sciana opakowania (dno), do której przylegaja tzw. zakladki montazowe, jest w kolorze ciemnobrazowym, a plaszczyzna prostokatnego zamykajacego dna posiada na obrzezach ciemnobrazowy pas tworzacy ramke dla znajdujacego sie posrodku bialego prostokata. Wyraz BARWA pisany jest duzymi drukowanymi literami w kolorze turkusowym. Umieszczone ukosnie pod i zachodzace górnymi czesciami liter na wyraz BARWA, slowo Siarkowa wykonane jest odrecznym stylizowanym pismem w kolorze czarnym z popielatym obrysem. Nad koncowa „a" slowa Siarkowa umieszczony jest w kólku znak „R" informujacy o zastrzezonym w UPRP znaku towarowym zglaszajacego. Pod nazwa serii umieszczone jest okreslenie znajdujacego sie w opakowaniu produktu skladajace sie z umieszczonych jeden pod drugim wyrazów: MYDLO SIARKOWE wykonanych duzymi literami w kolorze zólto-pomaranczowym. Obok wyrazów MYDLO SIARKOWE sa umieszczone lukowo kreski i strzalki w kolorze turkusowym. U góry wyrazu: SIARKOWE, umieszczona jest w kólku litera „R" informujaca o zastrzezonym znaku towarowym producenta. Pod okresleniem zawartego w opakowaniu produktu znajduje sie napis: PIELEGNACJA ANTYTRADZIKOWA wykonany czarnymi drukowanymi wersalikami. Ponizej, w pomaranczowej ramce o zóltawym tle znajduje sie u góry napis CALM DOWN, WE CARE ! pod którym podane sa informacje o produkcie. Pod ramka umieszczony jest tekst w jezyku angielskim: SULPHUR SOAP ANTI ACNE – CARE, wykonany duzymi drukowanymi bialymi literami. U dolu czolowej sciany opakowania na ciemnobrazowym tle lasu, umieszczone jest logo producenta w kolorze bialym. Na lewej bocznej sciance opakowania znajduja sie niezbedne, przydatne i wymagane informacje w kilku jezykach o produkcie wykonane drobna czarna czcionka. Prawa boczna scianka opakowania posiada u góry informacje o gramaturze produktu ponizej pochodzenie produktu, dokladne dane producenta oraz dodatkowe informacje o przydatnosci produktu. U dolu prawej bocznej scianki opakowania umieszczony jest na bialym tle kod kreskowy produktu w kolorze czarnym, nad którym znajduje sie haslo reklamowe podkreslone skierowana w lewo strzalke, haslo reklamowe w kolorze zóltawym. Tylna sciana opakowania posiada umieszczone jedna pod druga pomaranczowe ramki o zóltym tle, w których umieszczone sa pisane drobna czarna czcionka szczególowe wymagane informacje o produkcie, w tym jego przeznaczeniu, sposobie stosowania, wlasciwosci oraz skladnikach podane w kilku jezykach. W górnych rogach pomaranczowych ramek, w pomaranczowych kólkach znajduja sie turkusowe piktogramy korespondujace z zawartymi w ramkach informacjami. Pokazana na Fig. 2 druga odmiana opakowania posiada na czolowej scianie pod napisem z nazwa serii produktu: BARWA Siarkowa, umieszczone w dwuwierszu okreslenie zawartego w opakowaniu produktu: KREM SIARKOWY NAWILZAJACY wykonane duzymi drukowanymi literami w kolorze turkusowo-niebieskim. Pod znajdujaca sie ponizej pomaranczowa ramka z tekstem informacyjnym, umieszczony jest wykonany duzymi bialymi literami, napis w jezyku angielskim: MOISTURISING SULPHUR CREAM – ANTI – ACNE CARE. Prawa boczna scianka opakowania zawiera u góry informacje o skladnikach produktu, a u dolu ponizej podaje informacje o gramaturze i pochodzeniu produktu a takze pelne dane producenta i kod kreskowy produktu z haslem reklamowym. Na ilustracji Fig.2 opakowania w stanie rozlozonym w widoku z góry, pokazano zaznaczone pomaranczowa przerywana kreska miejsca zagiec montazowych scian opakowania oraz wewnetrznych i zewnetrznych zakladek. Pod znajdujaca sie ponizej pomaranczowa ramka z tekstem informacyjnym, umieszczony jest napis w jezyku angielskim: MATTYFYING SULPHUR CREAM – ANTI – ACNE CARE, skladajacy sie z duzych drukowanych bialych liter. Prawa boczna scianka zawiera u góry informacje o skladnikach produktu, a u dolu ponizej podana jest informacja o gramaturze i pochodzeniu produktu, podane sa pelne dane producenta i umieszczony jest kod kreskowy produktu z haslem reklamowym. The essence of the industrial design is a new form of cosmetic packaging manifested in its individual character given to it by the shape, graphic composition, especially the background, colors, arrangement of verbal elements and lettering, which resulted in an original external appearance of the packaging, increasing the attractiveness of the cosmetic products contained in the packaging for buyers. The cosmetic packaging and its variants are presented in the attached illustration, in which: Fig. 1 - shows packaging intended for sulfur soap, in an unfolded top view; Fig. 2 - shows a top view of the unfolded packaging intended for the moisturizing sulfur cream; Fig. 3 - shows packaging intended for the mattifying sulfur cream, in an unfolded top view. The cosmetics packaging that is the subject of the industrial design in each version has the shape of a cuboid, which when unfolded creates a cube. The background of the front and back walls, as well as the side walls of all versions of the packaging, is at the bottom a dark brown irregular stripe depicting fragments of the forest located at the foot of the mountain ranges shown in a panoramic perspective, in orange in various shades. The background of the front wall, side walls and back wall, as well as the top wall (lid, cover) located above the orange mountains is peach-yellow. On the other hand, the bottom wall (bottom) has a dark brown stripe on the edges, creating a frame for the white rectangle located in the middle. On the top wall (lid, cover) of all versions of the packaging there is an inscription consisting of the words: BARWA Siarkowa, which is the name of the product series. The word BARWA is written in large, turquoise block letters. Placed diagonally below and overlapping the upper parts of the letters on the word BARWA, the word Siarkowa is written in handwritten, stylized black script with an ash-gray outline. Above the final letter ("a") of the word Siarkowa, there is a circled "R" sign informing about the manufacturer's registered trademark No. 281173. On the front wall of each type of packaging, the name of the product series is placed: BARWA Siarkowa - identical to the one on the top wall (lid). Under the dominant name of the series, there is a description written in two lines, giving the type and name of the product placed in the package. Under the type of product, there is a single-line inscription: ANTI-ACNE CARE, written in black, block letters. Below, in an orange frame on a yellowish background, there is a note that introduces the product contained in the package. Under the frame, there is information in English about the purpose of the product. At the very bottom of the front wall of the package, there is the manufacturer's logo in white. The left side walls of each type of package contain information inscriptions in several languages in small black print. On the right side walls of the package, next to the information text, there is full manufacturer data, product weight and its barcode in black, with the barcode on a white background and at the top it has an advertising slogan in light orange. On the back walls of each type of package, there is the necessary and required information about the product, placed one below the other in orange frames with a yellowish background. In the upper corners of the frames there are blue pictograms in orange circles corresponding to the content of the information contained in the frames. The lower wall of the packaging (bottom), to which the so-called assembly tabs adhere, is dark brown, and the surface of the rectangular closing bottom has a dark brown strip on the edges, creating a frame for the white rectangle in the middle. Essential features of the industrial design The packaging according to the industrial design is intended for cosmetic products, having the shape of a cuboid which after folding creates a cube, has the following essential features: PL 25520 3 In the first variant, the packaging according to the industrial design shown in Fig. 1 in a top view in the unfolded state, intended for sulfur soap has the background of the front wall, front wall, left and right side walls and rear wall, in the form of an irregular dark brown strip of forest located at the bottom of the wall surface, located at the foot of mountain ranges presented in a panoramic perspective in colors of various shades of orange. The background of the surface of the packaging above the mountain range is in a muted peach-yellow color. The bottom wall of the packaging (bottom) has a dark brown rim that forms a frame for the white rectangle inside. On the top wall, which is the lid of the packaging, on a peach-yellow background, there is a centrally located, dominant inscription: BARWA Siarkowa, which is the name of the product. The word BARWA is written in large, turquoise capital letters. Placed diagonally under and overlapping the upper parts of the letters on the word BARWA, the word Siarkowa is written in handwritten, stylized black script with an ash-gray outline. Above the final "a" of the word Siarkowa, there is a circle with the sign "R" informing about the applicant's trademark registered in the Polish Patent Office. On the front wall of the packaging at the top, there is an inscription identical to the one on the lid with the name of the product series: BARWA Siarkowa. Under the series name, there is a description of the product in the packaging, consisting of the words: MYDLO SULKOWE, written in capital letters in yellow and orange, placed one below the other. Next to the words MYDLO SULKOWE, there are arc-shaped lines and arrows in turquoise. At the top of the word: SIARKOWE, there is the letter "R" in a circle, informing about the manufacturer's registered trademark. Under the name of the product contained in the package, there is an inscription: PIELEGNACJA ANTYTRADZIKOWA written in black capital letters. Below, in an orange frame with a yellowish background, there is an inscription at the top: CALM DOWN, WE CARE!, under which information about the product is provided. Under the frame, there is text in English: SULPHUR SOAP ANTI ACNE – CARE, written in large, white capital letters. At the bottom of the front wall of the package, on a dark brown forest background, there is the manufacturer's logo in white. On the left side wall of the package, there is necessary, useful and required information in several languages about the product written in small black font. The right side wall of the package has information about the product weight at the top, below the product origin, detailed manufacturer's data and additional information about product suitability. At the bottom of the right side wall of the packaging, on a white background, there is a black product barcode, above which there is an advertising slogan underlined by an arrow pointing to the left, the advertising slogan in yellow. The back wall of the packaging has orange frames placed one below the other on a yellow background, in which detailed required information about the product is placed in small black font, including its purpose, method of use, properties and ingredients given in several languages. In the upper corners of the orange frames, in orange circles, there are turquoise pictograms corresponding to the information contained in the frames. The second type of packaging shown in Fig. 2 has on the front wall, under the inscription with the name of the product series: BARWA Siarkowa, a couplet describing the product contained in the packaging: KREM SULPHOWY NAWIŁZAJACY (MOISTURIZING SULPHUR CREAM) in large, turquoise-blue block letters. Under the orange frame with information text below, there is an inscription in large, white letters in English: MOISTURISING SULPHUR CREAM – ANTI – ACNE CARE. The right side wall of the packaging contains information on the product ingredients at the top, and information on the product weight and origin at the bottom, as well as full manufacturer data and the product barcode with the advertising slogan. In the illustration Fig.2 of the packaging in the unfolded state in the top view, the places of assembly bends of the packaging walls and internal and external flaps are shown marked with an orange dashed line. PL 25520 4 In the third version of the packaging shown in the attached illustration material in Fig. 3, on its front wall, under the inscription with the name of the product series: BARWA Siarkowa, there is a description of the product contained in the packaging placed in two lines, consisting of the words: KREM SIARKOWY MATUJACY written in large block letters in the color of dark pink. Under the orange frame with information text located below, there is an inscription in English: MATTYFYING SULPHUR CREAM – ANTI – ACNE CARE, consisting of large block letters in white. The right side wall contains information on the product ingredients at the top, and at the bottom below it provides information on the product weight and origin, full manufacturer data and the product barcode with the advertising slogan.
